Seminar on complexity of creditor claims

Banking and security law were the topics at a seminar hosted by Limerick firm Holmes O’Malley Sexton (HOMS) yesterday.

Recent case law updates were analysed by banking specialists including representatives from AIB, Bank of Ireland, KBC and Ulster Bank.

Dr John Breslin SC discussed recent legal developments in banking and security law, highlighting the ever-increasing complexity of creditor claims.

Dr Breslin also gave insights on key tactical steps to effectively manage debt-collection and repossession litigation.

Enforcement

He also spoke in detail on legislation relating to receiverships and enforcement of securities and gave an update on the position of the courts regarding fixed versus floating charges through relevant case law.

Partner Lisa Killeen offered some legal insights into the technically demanding area of banking and corporate finance.

Lisa acts for both lenders and borrowers in loan transactions to include refinances, new lending and development finance and also has significant insolvency experience regularly advising liquidators of secured assets.
