Reduced ECtHR time-limit comes into effect

The European Court of Human Rights (ECtHR) has introduced a new four-month time-limit for lodging applications, which comes into effect from today (1 February).

Previously, applications could be made to the court up to six months after a final decision in the domestic courts.

Any final domestic determination up to and including 31 January 2022 will still fall under the six-month limitation period, with the new limit applying only to final determinations from that date onwards.

The change is happening because of Protocol No. 15 to the European Convention on Human Rights, which came into force on 1 August 2021.

The new time-limit has been adopted by the 47 member states of the Council of Europe.

Practitioners are being advised to consider any possible application to the ECtHR as soon as a final domestic determination is received.
