The Law Society’s Conveyancing Committee has advised practitioners that revised general conditions of sale are to be used in transactions on and after 1 November.
The 2023 general conditions have been adapted to provide for the use of gender-neutral language throughout, in keeping with the general move to more inclusive language.
Some language has also been adjusted to reflect more straightforward 'simple English' throughout, consistent with the general move in this direction in terms of legal drafting.
Some statutory references have been updated, and some capitalisation of terms for reference to defined terms have been updated.
Some further important changes include revision of General Condition 10, which provides a contractual obligation on a vendor who is disposing of a part of a folio to provide a map of the land(s) in sale.
The committee has also added General Condition 48, which allows for the electronic signing and exchange of Contracts for Sale.
