The Judicial Council has sent proposals for an overall increase of 16.7% in damages to be awarded for personal injuries to the Minister for Justice.
The full council met last week to consider draft proposals from the board of the judges’ body that were published in December.
The judges’ body is required to review the Personal Injuries Guidelines, which were first adopted in 2021, every three years.
A statement from the council earlier this week said that the amendments, as published in December, had been submitted to the Minister for Justice under section 7 (2B) of the Judicial Council Act 2019.
They must be approved by the Oireachtas before coming into effect.
The board of the Judicial Council had last year amended the increase proposed by a committee from an initial 15.6% to 16.7% to take account of updated inflation figures.
