Fingal County Council are seeking an Executive Solicitor for their Law Department, based in Grove Road, Blanchardstown. Fingal is a highly attractive place to live, work, visit and do business. It comprises a geographical area of 450 sq.km stretching from Balbriggan in the north, to Blanchardstown in the west and to Howth in the east. The area is defined by the diversity of its landscape and settlement patterns with rural, urban and suburban locations all rolled into one county. There is 88kms of coastline, three large protected estuaries and salt marsh habitats and 13 major beaches.

Fingal County Council is one of the county’s major local employers and currently employs approximately 1,600 staff. The Council is mandated to deliver a diverse range of functions and services which can be broadly described under the headings of the provision of physical and social infrastructure, housing, economic and tourism development, community development, recreation and amenity services and the management of the planning and environmental regulatory framework. The role of the County Council as provided for in law is to represent, lead and serve the communities of Fingal.

The Role

The Executive Solicitor’s appointment will be to the Law Department. The role includes responsibility for the management and successful delivery of a range of legal services and responsibility for the management and supervision of assigned staff. The person/s appointed will report to the Law Agent, Senior Solicitor or Senior Executive Solicitor or another officer as designated. 

Duties:

The successful candidate will be required to carry out all duties as assigned by the Law Agent from time to time.   The duties will mainly comprise of local authority conveyancing work and regulatory code enforcement proceedings and include but are not limited to the following:

- Acquisition and disposal of land and local authority housing stock

- Acquisition of open spaces

- First registrations 

- Statutory Vestings

- Acquisition of land arising out of compulsory purchase orders

- General advice on property matters to include drafting Agreements 

- Attendance at arbitrations/oral hearings/mediation

- Represent the Council in all Courts in regulatory code enforcement proceedings including injunctive relief.

- Rate collection proceedings

- Matters relating to planning and environmental legal research and advisory work 

- Cases involving the statutory functions and powers of local authorities to include Judicial Review proceedings

- Operation of an electronic case management system.

- Housing/landlord and tenant

- Compulsory purchase orders including attendances at oral hearings and property arbitrations 

Education, training, experience: 

Candidates must on the latest date of receipt of completed application forms for the office:

- Have been admitted and enrolled as a Solicitor in the State.

- Have at least three years’ satisfactory experience as a Solicitor including adequate experience of conveyancing and court work, after admission and enrolment as a Solicitor; and

- Possess a high standard of professional training and experience.

The ideal candidate shall:

- Hold a current practicing certificate from the Law Society of Ireland or be entitled to hold such a practicing certificate

- Possess excellent professional knowledge and skills

- Possess good advocacy skills and knowledge of court processes

- Possess a good knowledge of the legislation governing local authorities and statutory bodies

- Possess excellent interpersonal and communications skills and have the ability to engage with a wide range of people

- Possess good organizational skills and be able to develop efficient work practices and systems to enhance performance delivery

- Possess good knowledge of health and safety legislation and regulations, the implications for the organization and the employee and their application in the workplace

- Possess good IT skills.
