Eye on bail laws

A new report on Ireland’s bail laws examines how bail works in practice and the legal framework behind it.

An Assessment of the Efficacy of Bail Laws in Ireland, compiled by Lorcan Staines SC earlier this year, has been published by Minister for Justice, Home Affairs and Migration, Jim O’Callaghan TD.

The Law Society made several recommendations in a submission to Lorcan Staines SC – with many in the final report. These include:

  • better information for courts when considering bail applications,
  • reviewing legislation to allow for electronic monitoring/tagging, and
  • review of garda guidelines on releasing accused people on bail.

The review followed Minister OCallaghan’s apology to the family of Shane O’Farrell, who was killed in 2011 by a driver on bail.
