A resource for solicitors

The ADR guide provides practitioners with a practical summary of the wide range of dispute resolution methods available - covering mediation, arbitration, expert determination, adjudication, conciliation and various other forms of ADR. The pros and cons of each of these methods are identified, and the differences between the different methods are explained. Importantly for solicitors, the role of practitioners in each of the methods is also identified.

It is important for solicitors to have a good understanding of the many techniques for resolving disputes that are available, and to advise clients on their options. In the case of mediation, this a statutory obligation.

It is hoped that the booklet will serve as a quick and practical guide for solicitors to assist in ensuring that their clients are advised not just of the availability of ADR methods but also to help choose the most appropriate method in particular situations.

Promoting mediation

The updated ADR Guide supports the Law Society’s policy to promote the greater use and acceptance of mediation as an alternative to the more protracted and costly court-based litigation. The ADR Committee will support the promotion of Mediation through hosting a free CPD seminar titled ‘Mediation – a new era’ at the Law Society on 12 March.

This free in person event will feature a panel of experienced practitioners and aims to provide insights for solicitors advising clients in Mediation. Current and practical issues of interest will also be discussed. Speakers include; The Hon Mr Justice David Barniville, President of the High Court; Eamon Harrington, Mediator and current President of the Law Society; and, Helen Kilroy, Mediator and Partner in McCann Fitzgerald.
