WRC decisions and recommendations
The Workplace Relations Commission (WRC) has published decisions and recommendations from 31 March to 8 April 2025.
March and April employment case law
Cases and issues covered include:

an unsuccessful claim for constructive dismissal based on the employer's alleged failure to resolve visa issues in a timely fashion (Felipe Rocha Sales Junior v Foxfield Inns Dac Ashling Hotel, ADJ-00048714);
-
a claim for unfair dismissal where the facts surrounding a disputed resignation were inferred by WhatsApp messages and the employee's conduct (Aleksandras Jacukevicius v ICM Company Management and Secretarial Services Limited, ADJ-00054602); and
-
an unsuccessful defence to an Organisation of Working Time Act claim based on the complainant having control over his working hours (Mark Alcock v Knights Tower Trading Limited trading as Knightsbrook Hotel Spa and Golf Resort, ADJ-00049112).
